
Dutch Internet Service Provider XS4ALL reportedly has been summoned to appear in Court in Utrecht on November 20 in connection with its alleged refusal to assist with an Internet tap. The Ministry of Justice wanted XS4ALL to tap all Internet communications (including e-mail, World Wide Web, news groups, IRC and all other Internet services) to and from a particular user for one month and to pass the information along to police.
XS4ALL refused the order to monitor the communications and Web surfing activities of one of its users believing that there were insufficient legal grounds for the monitoring order. XS4ALL therefore claims that the order is an illegal method of investigation. The company questions whether the law allows courts to order the disclosure of computer records that do not exist at the time of the order using the legal method employed.
