The March 3, 1999 court hearing, in the case of Dr. Bruce Steir, has been stayed due to a recent California Supreme Court decision.
The California Supreme Court, on February 24, 1999, granted review in the case of Dr. Bruce Steir, an abortion provider facing an unprecedented charge of second degree murder in Riverside County. The Court acted on Dr. Steir's petition alleging that his prosecution is politically motivated based on unconstitutional discrimination against him. The petition seeks access to official documents and records to prove his claim. The Supreme Court ordered all proceedings in the case stayed until the petition is resolved.
What does this mean? The California Supreme Court referred this case back to Riverside County's Court of Appeals, requiring that the Court of Appeals issue an alternative writ. This means that the Medical Board must give requested documents to the defense or show cause why they feel they should not be required to do so. This may result in an additional hearing.
